Travel Agent Terms

These Travel Agent Terms explain how the StayEasy travel agent programme works β what you pay, when you pay it, and what happens when a booking changes. They are written for travel agents, tour operators, destination management companies and corporate travel desks booking on StayEasy for their own clients.
This page is a summary and forms no part of your contract. The agreement you accept when you register is the Travel Agent Partner Agreement, linked at the foot of this page. Where this summary and that agreement differ, the agreement applies.
1. Who we are
The platform is operated by Stay Easy Co Ltd, a company incorporated in the Republic of Mauritius, Business Registration Number C26232251, holding Tourist Enterprise Licence No. 17859 as an Online Tour Operator, with its registered office at Bundhun Road, L'Aventure 1410-04, Republic of Mauritius. In these Terms, "StayEasy", "we" and "us" mean that company, and "you" means the business holding the agent account.
We are a disclosed agent for the properties listed on the platform, and we collect payment on their behalf. We are not the provider or operator of any stay. The travel contract is between your client and the property.
2. Who may hold an agent account
An agent account is for businesses that sell travel to their own clients. By applying you confirm that:
- you are acting for a business, not as a consumer;
- you are authorised to act for the business you name, and to bind it;
- you hold every licence your activity requires β including a Tourism Authority travel agent or tour operator licence where that applies to you β and will keep it current; and
- the information you give us is accurate, current and complete, and you will keep it so.
We may decline any application, and we may ask for evidence of your identity, authority or licensing at any time.
3. Registering, and what activation means
You register in the agent portal and accept the Travel Agent Partner Agreement there. We then verify your business registration, your licence, your address, your beneficial ownership and the identity of the person signing.
Registering is not activation. Your account gives you nothing until we activate it. Activation is our countersignature β the agreement starts on that date, and only then can you make bookings or see trade pricing. We may decline or defer activation until we are satisfied.
4. How the programme works
You book on StayEasy for your own client, at the price shown on the platform, and you pay us that price less your agent margin at the moment you book. We pay the property in full, on its usual terms.
What you charge your client is entirely your business. It happens outside our platform, on your own paperwork. We never see it, and neither does the property.
- You see the same inventory and the same retail prices as any traveller, plus your trade price.
- You may charge your client whatever you determine β but you must not present any figure as being our price or the property's price other than the retail price shown on the platform.
- The programme is non-exclusive. You are free to book elsewhere, and we continue to sell directly and to appoint other agents.
5. What you pay
Your margin is 5% of the price shown on the platform, on everything you book β stays, transfers, car rental, experiences and add-ons alike. It is deducted at source, so you simply pay 95% at the time of booking. There is no invoice to us, no waiting, and no payment back to you.
Government charges β tourist fees, levies and similar β are shown separately and are never subject to margin. Where a charge is collected by the property on arrival, it sits outside the booking price entirely.
Payment is due at the time you book and confirms the booking. Sums are payable in Mauritian rupees unless the portal displays and accepts another currency, in which case the rate is fixed at the moment of booking.
Credit. The default is payment at booking. Credit terms exist, but only by a credit schedule signed by our Director. No one else at StayEasy can grant them, and no pattern of dealing creates them.
6. Your margin is confidential
Your rate, and anything from which it could be worked out, must not be disclosed to a property or to your client. Properties do not see trade pricing, and you should not suggest to a property that you have any direct entitlement from them for a booking made through us.
7. Cancellations, amendments and refunds
Every booking follows the cancellation tier the property published for that rate, at the moment you booked. We apply that tier to the retail price, and your margin comes off whatever is not refunded.
You must tell your client the property's terms before booking, and you must not offer them anything more generous than what the property published. If you do, that difference is yours to carry.
A date change agreed with the property after a cyclone warning, an official advisory or a comparable safety event is treated as an amendment, not a cancellation. No cancellation charge arises from it.
Refunds go back to the account the payment came from, within ten business days of the refund being determined.
8. If something goes wrong

| A refund exceeds what you paid us, or a chargeback lands | The excess becomes a debt owed to us. We may set it off against other refunds, or require the full retail price on your next bookings until it clears. |
| A card is used fraudulently | Where it is a payment-process matter and not attributable to you or your client, we carry it. |
| Your client does not pay you | That is between you and them. It does not change what you owe us. |
Your remedy for a property failing to perform is against us, under the agreement, and not against the property directly β unless your client has a direct statutory right.
9. Your login and your people
Each person in your business who uses the portal has their own credentials. Keep them secure and do not share them. You are responsible for everything done under your account, by anyone. Enable any additional authentication we require, and tell us immediately if you think an account has been used without your authority.
You add and remove authorised users yourself in the portal. We may refuse or revoke any of them on reasonable grounds.
10. Using the portal properly
You must not:
- submit client details you know to be inaccurate or incomplete;
- book for your own account to resell to someone who is not your client, or operate as an undisclosed sub-platform, without our written consent;
- copy, scrape, cache or extract data from the platform, or resell access to it;
- attempt to reach accounts, systems or data that are not yours; or
- interfere with the platform's operation or security.
You may say that you book through StayEasy, but you need our written approval before using our name or logo in your own advertising or materials.
11. Client information
You and StayEasy each act as a separate and independent controller under the Data Protection Act 2017 in respect of the personal data you pass us. We are registered as a data controller under certificate C23496.
Send us only what the booking needs. Give your client our privacy notice or an equivalent, keep their data secure, and tell us without delay if there is a breach affecting data shared under the agreement. We use what you send only to make and deliver the booking and to keep our records, and we pass it to the property only so far as the booking requires.
12. Two rules that protect both sides
You will not go around us to a property
For twelve months after your first booking with a property you met through StayEasy, you will not book that property directly for your clients. This does not touch properties you already traded with before joining β tell us and show us if it comes up.
We will not go around you to your client
For twelve months after a booking, we will not use your client's details to solicit them or pull their future bookings away from you. If we break that, you can recover the margin you would have earned. This protects clients you introduced to us β not people already booking with us or approaching us independently.
13. Suspension and closure
We may suspend your access β to the portal, to a user, or to a product category β without ending the agreement, where a sum is overdue, a licence has lapsed or cannot be evidenced, a complaint or suspected fraud is under investigation, or a supplier, payment scheme, bank or regulator requires it. Suspension does not touch bookings already confirmed.
Either of us may end the agreement on thirty days' notice, for any reason. Serious breach, insolvency or losing a required licence allows immediate termination. Bookings already confirmed continue to be governed by the agreement until they are performed or cancelled, and all sums due become payable.
14. The platform itself
We provide the portal as it stands and as it is available. We work to keep it running, but we do not promise it will be uninterrupted or free of error. We may change, improve or extend it, and we may schedule maintenance, giving reasonable notice where that is practical.
Nothing in these Terms or in the agreement limits any liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
15. Changes
We may update these Terms and the agreement. A change to the agreement takes effect through the agent portal with your electronic acceptance, or by a document signed by our Director. A change to your margin takes effect on fourteen days' notice; continuing to use the portal after that means you accept it.
16. Law
These Terms and the agreement are governed by the laws of the Republic of Mauritius. If something goes wrong, contact us first and we will try to resolve it in good faith between senior people on both sides. Any dispute that cannot be resolved is for the courts of the Republic of Mauritius.
The agreement itself
Everything above is a summary. The document that binds us is the Travel Agent Partner Agreement β thirty clauses and four schedules, executed electronically in the agent portal. Read it before you accept it at registration.
